Terms & Conditions

Last updated:

These Terms & Conditions ("Terms") govern your use of the Smart QR Code website and service at smart-qr-code.com (the "Service"). By creating an account or using the Service, you agree to these Terms. If you do not agree, please do not use the Service.

1. Who we are

The Service is operated by:

  • STROE GEORGE-ADRIAN PERSOANĂ FIZICĂ AUTORIZATĂ (a sole trader registered in Romania)
  • Registered office: Municipiul București, Sector 2, Str. Baicului nr. 82, et. 2, corp C31 – Administrativ, camera 38, Romania
  • Tax identification number (CUI): 40410638
  • Trade Register registration number: F40/56/2019
  • Email: [email protected]

In these Terms, "we", "us" and "our" refer to the above. "You" refers to the person or organisation using the Service.

2. Definitions

  • Static QR code — a QR code that encodes your content directly in the image. Once generated and downloaded, it works entirely offline and does not pass through our servers.
  • Dynamic QR code — a QR code that encodes a short link on our domain. When scanned, our servers redirect the visitor to a destination you control and may record scan analytics.
  • Scan Data — the information recorded when someone scans a Dynamic QR code, as described in our Privacy Policy.
  • Your Content — everything you upload or enter, including destination URLs, names, logos and files.

3. The Service

3.1 Free QR code generator

The QR code generator on our home page produces Static QR codes. It is free to use, requires no account, and the codes it produces do not expire and will keep working indefinitely, including if you stop using our Service or if our Service ceases to exist. This is a technical property of static QR codes: the data lives in the image, not on our servers. We commit to not adding an expiry mechanism to codes already generated in this way.

3.2 Account features and Dynamic QR codes

An account gives you Dynamic QR codes, scan analytics, folders, bulk generation, logo upload, an API and other features depending on your plan. Unlike Static codes, Dynamic QR codes depend on our servers to work. See section 6.3 for what happens if your subscription ends.

4. Your account

  • You must provide accurate information and keep it up to date.
  • You are responsible for keeping your password and API keys confidential, and for all activity under your account.
  • An account is for one person or one organisation. Do not share credentials.
  • You must be at least 16 years old, or the minimum age of digital consent in your country if higher.
  • Tell us promptly at [email protected] if you suspect unauthorised access.

5. Free trial

New accounts receive a 14-day free trial with full access. No payment details are required to start the trial and it does not convert into a paid subscription automatically — nothing is charged unless you actively choose a plan.

When the trial ends without a paid plan, your account remains open and you keep access to what you have already created, but you cannot create or edit QR codes, upload new files or view analytics. Your Dynamic QR codes keep working as described in section 6.3.

6. Plans, billing and cancellation

6.1 Paddle is the seller

Our order process and payments are handled by Paddle. Paddle is the Merchant of Record for all purchases: Paddle sells the subscription to you, issues the invoice, and collects and remits any applicable sales tax or VAT. Paddle's own terms and privacy notice apply to the payment transaction in addition to these Terms, and you may need to exercise certain consumer rights against Paddle as the seller.

We never receive or store your card details. We only receive confirmation of your subscription status and an identifier linking it to your account.

6.2 Subscriptions

  • Subscriptions are billed monthly in advance in US dollars and renew automatically until cancelled.
  • Prices are shown on our pricing page. Taxes are calculated by Paddle at checkout based on your location.
  • You may cancel at any time. Cancellation stops future renewals; your plan stays active until the end of the period you have already paid for.
  • We may change prices. Existing subscribers will be notified by email before a price change takes effect, and may cancel before it applies.

6.3 What happens when a subscription ends

This is important, so we state it plainly:

  • Static QR codes are never affected. Anything you downloaded from the free generator, or exported as a static image, keeps working forever.
  • Dynamic QR codes keep working when your subscription ends or your trial expires without a plan. The first three Dynamic QR codes you created keep redirecting directly to their destination, with no time limit. Any other Dynamic QR code keeps redirecting too, but first shows a short page stating that it was made with Smart QR Code. Subscribing again removes that page immediately.
  • While you have no active plan, your account is read-only: you can see your QR codes, but you cannot edit them, create new ones or view analytics. Scans continue to be recorded.
  • We may disable a Dynamic QR code whose destination has become harmful (for example phishing or malware). We may also archive Dynamic QR codes of an account without an active plan that have not been scanned for twelve consecutive months, except the first three Dynamic QR codes described above. We will email you at least 14 days before archiving, listing the codes concerned; a single scan or choosing a plan before that date keeps them active. Archived codes are not deleted, and choosing a plan reactivates them.
  • Your account, QR code definitions and analytics history remain stored and become available again if you subscribe later, subject to section 10.

7. Acceptable use

You must not use the Service to create, host or point a QR code at content that:

  • is unlawful, fraudulent, deceptive, or infringes someone else's rights;
  • distributes malware, or conducts phishing or credential harvesting;
  • impersonates another person, business or brand;
  • contains sexual content involving minors, incites violence or hatred, or facilitates illegal goods or services;
  • is designed to disguise a destination in order to evade a platform's security checks.

You must not attempt to disrupt or gain unauthorised access to the Service, circumvent plan limits or rate limits, or resell the Service without our written agreement.

We may disable a specific QR code, suspend an account, or refuse service if we reasonably believe this section has been breached, or if we are required to do so by law or by a report from a security provider. Where practical, we will tell you why and give you a chance to respond.

8. Your Content and Scan Data

8.1 Ownership

You keep all rights in Your Content. You grant us a limited licence to host, process and display it strictly to operate the Service for you.

8.2 Your responsibility as the owner of a Dynamic QR code

When someone scans your Dynamic QR code, we record Scan Data — including the IP address of the person scanning, which is personal data under the GDPR. We collect it on your behalf and make it available to you as analytics.

In relation to Scan Data, you act as the controller and we act as your processor. This means you are responsible for:

  • having a lawful basis to collect analytics about the people who scan your codes;
  • informing those people, where required, for example in your own privacy notice or at the destination page;
  • responding to requests those people make about their data. We will assist you where we reasonably can.

We will process Scan Data only to provide the Service to you and as described in our Privacy Policy, keep it confidential, apply appropriate security measures, and not use it to build profiles or sell it to anyone. If you require a separate written Data Processing Agreement, contact us.

9. API

If your plan includes API access, you must keep your API keys secret, respect published rate limits, and not use the API to replicate the Service as a competing product. We may change or deprecate API endpoints; we will give reasonable notice of breaking changes.

10. Suspension, termination and deletion

  • You may stop using the Service at any time and may ask us to delete your account by writing to [email protected].
  • We may suspend or terminate an account for a serious or repeated breach of section 7, for non-payment, or where required by law.
  • After an account is deleted, we remove your QR codes, files and Scan Data within 30 days, except where we must keep records for legal or accounting reasons.
  • We may discontinue the Service as a whole. If we do, we will give at least 30 days' notice by email, and will not charge for a period we do not deliver. Static codes you have already downloaded remain unaffected.

11. Availability and warranties

We work to keep the Service available and reliable, but we do not guarantee uninterrupted or error-free operation. The Service is provided "as is" to the extent permitted by law. We do not warrant that scan analytics are complete or exact: some scans cannot be recorded, for example where a device blocks tracking or a network operator alters requests.

12. Limitation of liability

Nothing in these Terms limits liability that cannot be limited by law, including for death or personal injury caused by negligence, or for fraud.

Subject to that, we are not liable for indirect or consequential loss, loss of profits, revenue, goodwill or data, and our total liability arising out of or relating to the Service in any 12-month period is limited to the amount you paid for the Service in that period.

If you are a consumer, you keep all mandatory rights under the consumer law of your country of residence, and nothing here removes them.

13. Changes to these Terms

We may update these Terms. If a change materially affects your rights, we will notify registered users by email or in the application at least 14 days before it takes effect. Continuing to use the Service after that date means you accept the updated Terms. The date at the top of this page shows when it was last changed.

14. Governing law

These Terms are governed by the laws of Romania. Disputes will be subject to the jurisdiction of the competent Romanian courts. If you are a consumer resident in the European Union, you may also bring proceedings in the courts of your country of residence, and you keep the protection of the mandatory consumer rules that apply there.
